The Charter of the China-Central Eastern European Countries Higher Education Institutions Consortium

1. General Principles

1.1. The China-Central Eastern European Countries Higher Education Institutions Consortium (abbreviated as CCHEIC) is a non-profit organization allying higher learning institutions of China and Central Eastern European Countries (abbreviated as CEECs) on a voluntary basis.

1.2. The CCHEIC shall be operated following the Charter within the restraints of related international, Chinese and CEECs laws and regulations.

1.3. The CCHEIC was initiated and established jointly by 32 participating institutions of the Second China-CEEC Education Policy Dialogue in Tianjin, China on September 22, 2014.

1.4. The members maintain their independence and rights as legal entities.

1.5. The working languages of the CCHEIC are Chinese and English.

1.6. The Secretariat in China locates in China Education Association for International Exchange (160 Fuxingmen Nei Dajie, Yifu Convention Center, Beijing 100031). The first Secretariat in CEECs on rotation basis locates in Sofia University in Bulgaria.

1.7. The CCHEIC does not assume joint liabilities of her members.

2. Mission and major tasks

2.1. Mission

In the principle of mutual respect, equality, mutual benefit, to build a platform for partnerships, bring out the member institutions’ initiative, consolidate and share resources and deepen education exchange and cooperation between China and CEECs so as to push forward educational development and consolidate the basis of sustained social, economic and cultural development in the region with the strong support of the
people.

2.2.7. To support in-depth collaboration in science and research and other areas.

3. Rights and obligations of the CCHEIC

3.1. According to current laws and regulations, the CCHEIC has the right to conduct relevant businesses.

3.1.1. To represent the interests of its members in the legislation and law enforcement agencies in China and CEECs.

3.1.2. To attend the activities of other organizations, including activities organized by national, international and non-governmental organizations.

3.2. The obligations of the CCHEIC

3.2.1. To represent and protect the rights and interests of its members according to the Charter.

3.2.2. To provide service to its members in line with the objectives and missions of CCHEIC according to the Charter.

4. Rights and obligations of the members

4.1. Members join the CCHEIC on a voluntary basis. Unless otherwise stipulated, its members could conduct their own business with full autonomy and economic independence and engage voluntarily in all types of bilateral or multilateral exchanges.

4.2. The CCHEIC is open to the higher education institutions in China and CEECs who agree and abide by its Charter, mission and major tasks.

4.3. Rights

4.3.1. To possess the right to vote and to be elected.

4.3.2. To conduct exchange and cooperation with other members and universities, research institutions, international organizations, and companies within the framework.

4.3.3. To broaden and improve its business scope and content through the use of information, research and teaching resources, social and cultural connections and service systems owned by the CCHEIC.

4.3.4. To attend academic conferences, exhibitions, advanced training and other activities organized by the CCHEIC.

4.3.5. To facilitate the implementation of work programs and activities of the CCHEIC.

4.3.6. To withdraw from the CCHEIC.

4. 4. Members shall fulfill the following obligations:

4.4.1. To comply with the Charter of the CCHEIC.

4.4.2. To implement actively the work of the CCHEIC and strengthen cooperation among its members.

4.4.3. To submit all necessary information and data needed by the CCHEIC, including, but not limited to names, of the latest representatives, liaison persons and contact information.

4.4.4. To ensure that no information is disclosed which is detrimental to the rights and interests of CCHEIC and her members.

4.4.5. To implement the resolutions adopted by the General Assembly of the Members of the CCHEIC (hereinafter referred to as the General Assembly)

4.5. If a member fails to fulfil its obligations or violate the Charter and laws and regulations of relevant countries, its membership shall be revoked according to the resolution by the General Assembly.

5. The Governing Body of the CCHEIC

5.1. The day-to-day administration body of the CCHEIC is the Secretariat located in China and the Secretariat located in CEECs. The Chinese permanent secretariat is located in the China Education Association for International Exchange. The Secretariat of the CEEC side is elected by the member universities on a rotation basis of two years, and the consecutive rotation term shall be no more than two.

5.2.The Secretariats from both Chinese side and CEEC side should meet on an occasional basis, to exchange policy, practice and information, to design and promote cooperative programs and action plans, and to invite new CCHEIC member institutions.

6. New Members Admission Mechanism

6.1. The higher education institution concerned submits the application to the CCHEIC.

6.2. Applicant shall meet the following criteria:

6.2.1 It must be an
institution of higher learning with independent legal person status and be formally registered with the Ministry of Education of the resident country.

6.2.2 It must agree to and abide by this Charter.

6.3. If the applicant meets the above criteria, the Secretariats shall make a nomination to directly admit it as a formal member after review.

6.4. If a member fails to participate in the activities organized by the CCHEIC for two consecutive years, its membership shall be revoked following the vote by the General Assembly of CCHEIC.

7. CCHEIC's Legal and Financial System

The CCHEIC possesses no tangible or intangible properties or assets. Nor is it a legal person.

8. Documents of the CCHEIC

8.1. The Permanent Secretariat of CCHEIC maintains the following documents:

8.1.1. Relevant documents regarding the establishment of the CCHEIC

8.1.2. The minutes of each General Assembly of the CCHEIC, relevant resolutions and provisions;

8.1.3. The documents on the internal management of the CCHEIC.

8.2. The documents of CCHEIC shall be written in both Chinese and English. The two texts shall have the same legal effect.

9. Procedures for the Restructuring and Dissolution of the CCHEIC

9.1. The CCHEIC may be reorganized or dissolved in accordance with the decisions of the General Assembly of the CCHEIC and the court rulings.

9.2. The dissolution shall be handled by the Dissolution Committee appointed by the General Assembly. The management of the CCHEIC shall be transferred from the date of the appointment of the Dissolution Committee.

9.3. Dissolution Committee shall

9.3.1. complete the remaining business of CCHEIC

9.3.2. release the news on the dissolution of CCHEIC through the media.

9.4. After the CCHEIC is terminated, the documents of the CCHEIC shall be permanently preserved by the China Education Association for International Exchange.

10. Other Provisions

10.1. Any matters not covered by this Charter shall be handled in strict accordance with the laws in China and the sixteen Central and Eastern European countries and the relevant internal documents formulated by the CCHEIC. This Charter shall come into force on the day when the General Assembly of the CCHEIC adopts it.

10.2. Any matters not covered by the Charter shall be revised and supplemented at the General Assembly of Members of the CCHEIC.

4.4.4. To ensure that no information is disclosed which is detrimental to the rights and interests of CCHEIC and her members.

4.4.5. To implement the resolutions adopted by the General Assembly of the Members of the CCHEIC (hereinafter referred to as the General Assembly)

4.5. If a member fails to fulfil its obligations or violate the Charter and laws and regulations of relevant countries, its membership shall be revoked according to the resolution by the General Assembly.
